根據集團八五普法工(gong)作計劃(hua),近(jin)期集團企管法務部組(zu)織員工(gong)旁聽市中院二審(shen)審(shen)理一起勞動(dong)爭議糾(jiu)紛案(an)件。 基(ji)本案情:員(yuan)(yuan)(yuan)工(gong)(gong)A在運(yun)(yun)輸(shu)企業(ye)B公(gong)(gong)(gong)司(si)(si)從事貨車司(si)(si)機工(gong)(gong)作。2023年(nian)7月,員(yuan)(yuan)(yuan)工(gong)(gong)A通(tong)過某運(yun)(yun)輸(shu)平臺承接(jie)運(yun)(yun)輸(shu)業(ye)務,員(yuan)(yuan)(yuan)工(gong)(gong)A繳納(na)340元(yuan)(yuan)服務費后,承接(jie)了一筆3600元(yuan)(yuan)的(de)運(yun)(yun)輸(shu)業(ye)務。員(yuan)(yuan)(yuan)工(gong)(gong)A完成該筆業(ye)務后,扣除墊付(fu)的(de)服務費340元(yuan)(yuan),將剩(sheng)余3260元(yuan)(yuan),交(jiao)回公(gong)(gong)(gong)司(si)(si)。公(gong)(gong)(gong)司(si)(si)認為340元(yuan)(yuan)為押金(jin),平臺公(gong)(gong)(gong)司(si)(si)會退還給(gei)員(yuan)(yuan)(yuan)工(gong)(gong)A,以(yi)其(qi)侵占公(gong)(gong)(gong)司(si)(si)財產,違反公(gong)(gong)(gong)司(si)(si)規章(zhang)制度為由(you),解(jie)除勞動合(he)同。因經(jing)濟補償金(jin)問題,雙方發(fa)生糾紛,員(yuan)(yuan)(yuan)工(gong)(gong)A要求用(yong)(yong)人(ren)單位支付(fu)經(jing)濟補償金(jin),而B公(gong)(gong)(gong)司(si)(si)辮稱,本次解(jie)除勞動合(he)同屬于勞動者嚴重違反用(yong)(yong)人(ren)單位的(de)規章(zhang)制度的(de)的(de)情形,無需支付(fu)經(jing)濟補償金(jin)。 本(ben)案(an)爭議焦點:員工A扣(kou)留支(zhi)付平臺(tai)公司340元的(de)(de)(de)服務費(fei),是否符合,勞動者嚴(yan)重違反(fan)用人單位的(de)(de)(de)規章制度(du)的(de)(de)(de)的(de)(de)(de)情形。 以(yi)案(an)釋法(fa):用人(ren)單位(wei)根據(ju)勞動合同法(fa)第四條規定(ding),通過民主程(cheng)序(xu)制(zhi)(zhi)定(ding)的規章制(zhi)(zhi)度,不違反國(guo)家(jia)法(fa)律(lv)、行政法(fa)規及政策規定(ding),并已向勞動者公(gong)示的,可以(yi)作為(wei)確定(ding)雙方權利(li)義務(wu)的依據(ju)。本(ben)案(an)中,員(yuan)工A扣(kou)留支付平臺公(gong)司(si)340元的服務(wu)費(fei)(fei),是為(wei)公(gong)司(si)代付的服務(wu)費(fei)(fei),是否達到嚴重違反用人(ren)單位(wei)的規章制(zhi)(zhi)度的情形,舉(ju)證(zheng)責(ze)任在(zai)公(gong)司(si)。本(ben)案(an)警醒我(wo)們,在(zai)公(gong)司(si)勞動合同內容中,條款設置(zhi)要清(qing)晰完備,對于公(gong)司(si)規章制(zhi)(zhi)度需事先履行告(gao)知義務(wu)。 相關法條:勞(lao)動(dong)者(zhe)(zhe)有下列情形(xing)之一的(de)(de),用(yong)人(ren)(ren)單(dan)(dan)位(wei)可以解除勞(lao)動(dong)合(he)同(tong)(tong),不必支付經濟補償金:(1)在試用(yong)期間被(bei)證明不符(fu)合(he)錄用(yong)條件的(de)(de);(2)嚴(yan)重違反(fan)用(yong)人(ren)(ren)單(dan)(dan)位(wei)的(de)(de)規章制度(du)的(de)(de);(3)嚴(yan)重失職(zhi),營私舞弊,給用(yong)人(ren)(ren)單(dan)(dan)位(wei)造(zao)成(cheng)重大損害的(de)(de);(4)勞(lao)動(dong)者(zhe)(zhe)同(tong)(tong)時與其他用(yong)人(ren)(ren)單(dan)(dan)位(wei)建立勞(lao)動(dong)關系,對完(wan)成(cheng)本單(dan)(dan)位(wei)的(de)(de)工作任務(wu)造(zao)成(cheng)嚴(yan)重影響,或者(zhe)(zhe)經用(yong)人(ren)(ren)單(dan)(dan)位(wei)提出,拒不改(gai)正(zheng)的(de)(de);(5)因《勞(lao)動(dong)合(he)同(tong)(tong)法》第二(er)十六條第一款第一項規定(ding)的(de)(de)情形(xing)致使勞(lao)動(dong)合(he)同(tong)(tong)無(wu)效(xiao)的(de)(de);(6)被(bei)依法追究刑事責任的(de)(de)。(供稿(gao):企管法務(wu)部)
